If i am in 5-10 inferno mode where the items are tier 13 i still have a chance of geting some unique item?

If you are in inferno mode, you can no longer get tier 13 items but only tier 15.
Unique drops is possible in this stage but very rare.

Maybe you mean Hell difficulty. No, you can't get uniques there. Only inferno mode. I have to see for myself if you can get it on lower difficulties than inferno and dark.
